Terms of Service

These terms govern your use of Scottish Trade Intel ("the Service"), operated by Scottish Trade Intel ("we", "us", "our").

1. Service Description

Scottish Trade Intel provides weekly planning application intelligence to subscribers. We filter, score, and deliver validated planning applications from Scottish council planning portals as a PDF document sent to your email address every Monday.

2. Subscription and Payment

By subscribing to the Service, you agree to pay the subscription fee for your chosen tier (Starter, Local Pro, or Regional) on a recurring monthly basis. Payment is processed via Stripe. Your subscription will automatically renew each month unless you cancel.

Billing: You will be charged on the same day each month as your initial subscription date. If you subscribe on the 31st of a month, billing may occur on the last day of months with fewer than 31 days.

Council Area Selection: You choose which Scottish council areas to receive leads for based on your subscription tier. You may change your selected council areas at any time by contacting us at hello@scottishtradeintel.co.uk.

3. Cancellation and Refunds

Cancellation: You may cancel your subscription at any time. If you cancel, you will continue to receive the Service until the end of your current billing period, after which your subscription will not renew.

Refund Policy (The Trade Intel Pledge): If any issue feels like spam or does not provide value, contact us within 7 days of receiving that issue and we will refund the pro-rated cost of that week. No questions asked.

No Partial Refunds for Unused Time: We do not provide refunds for unused portions of a subscription period except as specified in our refund policy above.

4. Data Sources and Accuracy

Planning application data is sourced from public Scottish council planning portals. While we make reasonable efforts to ensure accuracy, we do not guarantee that all information is complete, current, or error-free. Planning application data is provided "as is".

Your Responsibility: You are responsible for verifying any planning application information before acting on it. We recommend contacting the relevant council or property owner directly to confirm details.

5. Permitted Use

The Service is intended for use by tradespeople and businesses seeking commercial opportunities from planning applications. You may:

  • Use the Service to identify potential business opportunities
  • Forward PDF issues to members of your team or business
  • Store PDF issues for your own business records

You may not:

  • Resell, redistribute, or republish our planning intelligence to third parties
  • Use automated tools to scrape, harvest, or bulk-download our content
  • Share your subscription login credentials with others outside your business
  • Use the Service for any unlawful purpose or to harass property owners

6. Subscriber Cap and Availability

Each council area is capped at 50 subscribers to maintain the value of the intelligence. If a council area reaches capacity, it may become unavailable for new subscriptions. We reserve the right to adjust capacity limits at our discretion.

7. Intellectual Property

The Service, including our scoring methodology, analysis, formatting, and presentation of planning application data, is our intellectual property. While planning applications are public record, our curation, scoring, and analysis constitute original work protected by copyright.

8. Limitation of Liability

To the fullest extent permitted by law, Scottish Trade Intel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service
  • Any inaccuracy or incompleteness in planning application data
  • Business opportunities pursued based on information provided by the Service
  • Any interruption or cessation of the Service

Maximum Liability: In no event shall our total liability to you exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Service Changes and Termination

We reserve the right to:

  • Modify subscription pricing for new subscribers (existing subscribers maintain their rate)
  • Add or remove council areas from coverage
  • Change the format or delivery method of the Service with reasonable notice
  • Suspend or terminate the Service entirely with 30 days' notice and a pro-rated refund

10. Account Termination

We may suspend or terminate your access to the Service if:

  • You breach these Terms of Service
  • Your payment fails or your account is past due
  • You engage in fraudulent or abusive behaviour
  • We are required to do so by law

11. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the Scottish courts.

Informal Resolution: Before initiating any formal proceedings, please contact us at hello@scottishtradeintel.co.uk to attempt to resolve the matter informally.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
